1. Introduction

These Terms of Service ("Terms") govern your use of the Atomic Goats platform, operated by Atomic Goats Ltd ("we", "us", "our"), a company registered in England and Wales, company number 17068754, with its registered office at 8 Roman Way, Stilton, Peterborough, England, PE7 3RU.

By accessing or using Atomic Goats, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

2. Service Description

Atomic Goats provides an AI-powered personal style platform that combines virtual try-on, AI styling, and colour analysis to help users visualise complete outfits. Our services include:

• AI stylist, personalised outfit recommendations based on your wardrobe and colour palette
• Virtual try-on, complete outfit visualisation, not just single garments
• Colour analysis, personal palette matching to find colours that suit you
• E-commerce integration capabilities
• Licensed model image library access

3. Eligibility and Age Requirements

You must be at least 18 years old to use Atomic Goats. By creating an account or using our services, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the service under applicable laws

We do not knowingly provide services to individuals under 18. If we discover that a user is under 18, we will immediately terminate their account and delete associated data.

4. Account Registration

To use certain features of Atomic Goats, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access
• Accept responsibility for all activities under your account

5. Licence Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the Atomic Goats platform for its intended purposes. This licence does not permit you to:

• Reverse-engineer, disassemble, or decompile any part of our software
• Sublicense, rent, lease, or sell access to the platform
• Use the service to develop competing products
• Remove or alter any proprietary notices or watermarks

6. User Content and Image Uploads

When you upload images to Atomic Goats:

• You retain ownership of your original images
• You grant us a licence to process your images for service delivery
• You represent that you have the right to use any images you upload
• You must only upload images of yourself or images you have explicit permission to use

Generated outputs are licensed to you for personal or commercial use in accordance with your subscription tier, subject to our Acceptable Use Policy.

7. Prohibited Uses

You agree not to use Atomic Goats to:

• Create content featuring individuals without their explicit consent
• Generate deceptive, fraudulent, or misleading content
• Produce content that is illegal, harmful, or violates others' rights
• Create explicit, adult, or inappropriate content
• Harass, defame, or harm any individual or entity
• Violate any applicable laws or regulations

8. Intellectual Property

The Atomic Goats platform, including its software, design, and content, is owned by Atomic Goats Ltd and protected by United Kingdom copyright laws and international intellectual property treaties. All rights not expressly granted are reserved.

9. Payment, Subscriptions, and Cancellation

Paid features are billed according to your selected subscription plan. By subscribing, you agree to:

• Pay all applicable fees for your subscription tier
• Automatic renewal unless cancelled before the renewal date
• Our refund policy as stated at the time of purchase

Free Trial

We may offer free trials for new users. Free trial terms:

• One free trial per person/household
• Free trial converts to paid subscription unless cancelled before trial ends
• We reserve the right to limit or terminate free trials at any time
• Abuse of free trials (e.g., creating multiple accounts) will result in account termination

Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

• You retain access until the end of your current billing period
• No partial refunds are provided for unused time
• Unused credits expire at the end of your subscription
• You may resubscribe at any time at the then-current rates

Account Deletion

You may request deletion of your account by contacting support@atomicgoats.com. Upon deletion:

• Your account and profile information will be permanently deleted
• All uploaded images and generated content will be removed from our systems
• This action is irreversible
• We may retain anonymized data for analytics and legal compliance purposes

10. AI Output and Refund Policy

Atomic Goats uses generative AI technology to produce virtual try-on images. By using our service, you acknowledge and accept that:

• Variable Output Quality - Generative AI produces results that may vary in quality, accuracy, and realism. Results depend on many factors including input image quality, lighting, pose, and the inherent limitations of AI technology.
• No Guaranteed Results - We cannot guarantee that every generation will meet your expectations or produce usable output. Some generations may fail, produce artifacts, or not accurately represent the intended result.
• No Refunds for Output Quality - Due to the nature of generative AI, refunds are not provided for generations that fail, produce low-quality results, or do not meet your subjective expectations. Credits or subscription fees are consumed when a generation is attempted, regardless of the output quality.
• Service Credits - In cases of technical platform failures (not AI output quality), we may at our sole discretion provide service credits for future use.

We continuously work to improve our AI models, but the probabilistic nature of generative AI means that perfect results cannot be guaranteed for every generation.

11. Disclaimer of Warranties

THE ATOMIC GOATS PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATOMIC GOATS LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Atomic Goats Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the platform or violation of these Terms.

14. Termination

We may suspend or terminate your access to Atomic Goats at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your licence to use the platform immediately ceases.

15. Assignment and Business Transfers

You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without our prior written consent.

We may assign, transfer, or delegate any of our rights and obligations under these Terms without your consent in connection with:

• A sale of all or substantially all of our assets
• A merger, acquisition, or consolidation with another entity
• A corporate reorganisation or restructuring
• A sale or transfer of a business unit or division
• A joint venture or partnership arrangement
• Bankruptcy, insolvency, or receivership proceedings
• Any other change of control transaction

In the event of any such assignment or transfer:

• These Terms shall be binding upon and inure to the benefit of the successor entity
• The successor entity shall assume all of our obligations under these Terms
• We will notify you of any such assignment or transfer
• Your continued use of the platform following such notification constitutes acceptance of the assignment

By agreeing to these Terms, you acknowledge and consent to the potential assignment of this agreement to a third party in connection with a business transition as described above.

16. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved through mediation in London, with arbitration as the final recourse if mediation fails.

17. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or platform notification. Continued use of Atomic Goats after changes constitutes acceptance of the revised Terms.
